What we need
This website will be what is known as the "Controller" of the personal data you provide to us, which may include name, address, email and so on.
Why we need it
Your data is collected primarily for fulfilment of your orders and relaying of messages you send through this website.
What we do with it
Your data provided to this website is relayed to the website owner, and is archived by the website service provider Theimagefile.com. The service provider data archive exists primarily in Ireland.
How long we keep it
Your online order data is stored for a number of years as required by tax law. Some aspects of your online order data can be anonymised at your request and to the extent allowable by law. Your other non-order data (i.e. marketing or messaging data) can be deleted or anonymised at your request, as per requirements of General Data Protection Regulation (GDPR). You may also unsubscribe from marketing communications at any time.
What are your rights?
If at any point you believe the information we process on you is incorrect, you may request to see this information and even have it corrected or deleted. If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Protection Officer who will investigate the matter. Unless otherwise stated in this document, the managing director of this website acts as the EU Data Protection Officer (DPO) and can be reached from the contact page of this website.
If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law you can complain to the Information Commissioner's Office (ICO).

Strictly Necessary
These are the cookies that are essential for websites to perform their basic functions. These include those required to allow registered users to authenticate and perform account related functions, as well as to save the contents of virtual "carts" on sites that have an e-commerce functionality:
sid - temporary session cookie identifier, used for login sessions and shopping cart
tif_cem - temporary session cookie for current email, used for secure albums requiring email login

Unless otherwise noted below, we do not use persistent cookies, nor cookies for optional functionality, AB testing, performance, advertising and so on.
Third Party/Embedded Content
This website may make use of different third party applications and services to enhance the experience of website visitors. These include social media platforms such as Facebook and Twitter (through the use of sharing buttons), or embedded content from YouTube and Vimeo, or tracking services such as Google Analytics. Web beacons and other tracking technologies
Both websites and HTML e-mails may also contain other tracking technologies such as "web beacons". These are typically small transparent images that provide us with statistics, for similar purposes as cookies. They are often used in conjunction with cookies, though they are not stored on your computer in the same way. As a result, if you disable cookies, the web beacons may still load, but their functionality will be restricted.
RETURNS & REFUNDS
All image orders are by their nature, bespoke. That is to say, when an order is placed for specific prints or print products, they are custom-printed just for you. As such there are no refunds on print orders. In the event that the wrong photo or photos are sent to you, or the order is incomplete, Michael Cockerham Photography will send the correct items to you free of charge.
In the event a defective product is supplied, and provided that such defects are reported to Michael Cockerham Photography within three working days of receipt, the affected products will be replaced free of charge. Where such defect is as a result of shipping damage, a separate claim must also be registered with the carrier.
For digital downloads there are no refunds available once they have been received by the client. Should the download fail additional downloads of the same files will be made available free of charge.
Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any non customised or bespoke item within seven working days of delivery. However, we regret that we cannot accept cancellations of orders where the item has been used, not in its original condition or without all its packaging. This policy does not apply to custom made products such as digital images, prints, canvases, framed images, art blocks, block mounts, acrylics and other products that are made specifically to customer requirements.
PURCHASES
A contract for purchases made through this website is between Michael Cockerham Photography and you, and the sales agreement is based on your agreement with these terms.
Michael Cockerham Photography is not responsible for any errors made whilst placing an online order.
The Site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification. We will inform you of any changes to the advertised goods prior to despatch of such goods. If you are unhappy with these improved, altered or modified goods you may inform us within 7 days of receipt of your order. To receive a refund, the goods must be returned in their original unused condition and with all packaging intact, together with your receipt. We recommend that you retain all of the original packaging until you are sure that you intend to keep the goods. An administration fee of £15.00 per frame will be charged for all returns for refund. (Please note: The administration fee will only be charged if the item is not faulty, or does not differ significantly from the advertised goods.) Please see our specific Delivery & Returns policies which form, an additional part of these 'Terms and Conditions of Sale'.
Whilst we try to display goods on our Site that are held in stock, if the ordered goods are not available we will advise you of this as soon as practicable. You will be given the option of ordering an alternative product or receiving a full refund.
By submitting your order you are offering to buy the goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details on to couriers and other subcontractors), for future offers and products and feedback.

We are not obliged to supply the goods to you until we have confirmed that we have accepted your order and received payment in full. We may at our total discretion reject your order.
All drawings, specifications, sizes, photographs, descriptive matter and advertising published by us or contained on our Site are issued only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only. They do not form part of the Terms.
Michael Cockerham Photograpy reserves the right to 'crop' an image in order for it to fit the aspect ration of any ordered product. Such crops will always be the most suitable one possible.
Please note that the images you see on your screen may vary slightly in colour from your final product due to different computer screens being colour calibrated differently. Our screens are colour calibrated and profiled, and are matched to our printers and papers to maintain a full colour managed workflow. If your screen is not calibrated and profiled it is highly likely that the colours you see on your monitor will not be accurate.
Images may appear slightly different to your proof images due to the different materials and processes involved.
DELIVERY POLICY
Standard Delivery in the UK is esitmated to be 7 to 21 days, although it is generally less than this.
Where a customer opts for Express Delivery, the expected delivery period is 4-6 working days from the date of the order. Should the order not be received within 7 working days, Michael Cockerham Photography will provide a refund of the Express element of the delivery charge.
Delivery times to other parts of the world vary, and will be indicated to the customer when orders are despatched.
The content of and copyright in the Site is owned by or licensed to us. You are permitted to view individual pages for your own personal use. You are not permitted to print pages. Any other use must be with our prior written permission.
